Access to legal information is fundamental to access to justice. Yet accessibility refers not only to making legal documents available to the public, but also rendering legal information comprehensible to them. A vexing problem in bringing legal information to the public is how to turn formal legal documents such as legislation and judgments, which are often highly technical, to easily navigable and comprehensible knowledge to those without legal education. In this study, we formulate a three-step approach for bringing legal knowledge (...) to laypersons, tackling the issues of navigability and comprehensibility. First, we translate selected sections of the law into snippets (called CLIC-pages), each being a small piece of article that focuses on explaining certain technical legal concept in layperson’s terms. Second, we construct a _Legal Question Bank_, which is a collection of legal questions whose answers can be found in the CLIC-pages. Third, we design an interactive _CLIC Recommender_. Given a user’s verbal description of a legal situation that requires a legal solution, CRec interprets the user’s input and shortlists questions from the question bank that are most likely relevant to the given legal situation and recommends their corresponding CLIC pages where relevant legal knowledge can be found. In this paper we focus on the technical aspects of creating an LQB. We show how large-scale pre-trained language models, such as GPT-3, can be used to generate legal questions. We compare machine-generated questions against human-composed questions and find that MGQs are more scalable, cost-effective, and more diversified, while HCQs are more precise. We also show a prototype of CRec and illustrate through an example how our 3-step approach effectively brings relevant legal knowledge to the public. (shrink)

BY EXPLORING THE ONGOING CONTROVERSY WHETHER TEACHER-LED recitation of the Pledge of Allegiance in public schools is constitutional, this paper demonstrates how and why Christians have much to gain from reverting the pledge to its pre-1954 text. I expose critical weaknesses in recent strategies to retain the contested words "under God" in the pledge employed by litigants, amici curiae, several Supreme Court justices, and other interested parties. I additionally interrogate the prominent place the American flag holds in public life and (...) question whether such preoccupation rises to the level of fetishism or even idolatry. Finally, I conclude that pacifists and others who are critical of America's expanding military empire have good reason to reject the Pledge of Allegiance entirely, whether or not the nation is described as being "under God.". Though 2023 marks the sixtieth anniversary of Dr. Martin Luther King Jr.’s iconic “I Have a Dream” speech, my reflections on the theme of the 2023 annual meeting of the Society of Christian Ethics, “Vision, Imagination, and Dreams in the Work of Ethics,” are inspired by King’s lesser known “Beyond Vietnam” speech. I connect my hopes for the future of Christian ethics to King’s still unrealized vision of social transformation. It is one where the US (and other empires) would affirm—not (...) subvert—each people’s right to self-determination and we scholar-activists would continue to search for connections between and among social issues even if others insist upon their discreteness. THE OCCASION FOR THE ESSAYS RESPONDING TO MANAGING DIVERSITY IN academe follows in response to a challenge issued by Miguel De La Torre in a 2006 plenary panel regarding the invisibility of minority scholars' work in SCE publications. That 2006 panel, which included presentations by De La Torre, Melanie Harris, Gabriel Salgado, and Darryl Trimiew, stimulated discussions in both the Women's Caucus and the meeting of the Board of Directors; this set of essays from a 2008 plenary session and a (...) concurrent session held later in the meeting is the result of those earlier discussions. The two sessions both address diversity: these essays feature minority voices presenting specific proposals for how minority scholarship should and should not be used by majority and other minority scholars; the concurrent session featured a discussion by majority scholars on what whites must do to diversify the society. Our hope is that these essays and the discussions they generate will shed more light on this extremely complex and important issue for the SCE and the institutions in which members work. (shrink)

Bioethicists have long been concerned that seriously ill patients entering early phase (‘phase I’) treatment trials are motivated by therapeutic benefit even though the likelihood of benefit is low. In spite of these concerns, consent forms for phase I studies involving seriously ill patients generally employ indeterminate benefit statements rather than unambiguous statements of unlikely benefit. This seeming mismatch between attitudes and actions suggests a need to better understand research ethics committee members’ attitudes toward communication of potential benefits and risks (...) of early phase studies to potential subjects. We surveyed the members of two U.S. research ethics committees using a phase I gene transfer study scenario, and compared the results to a previous survey of potential subjects’ perceptions and attitudes toward benefit and risk for the same protocol. The results show that there is indeed a gap between the subjects’ perceptions and the committee members’ views on what is appropriate to be communicated to research subjects. This discrepancy is the product of both the commonly assumed optimism of the subjects and to a “protective pessimism” of the research ethics committee members. We discuss this discrepancy using “frameworks of trust” and demonstrate the need to incorporate these frameworks into the existing model of informed consent. (shrink)

Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Kao’s book opens by asking whether “the very idea of human rights [must] be premised upon a religious or metaphysical idea in order to be conceptually intelligible, sufficiently protected, or practically stable over time” (4). Kao proposes that this question has generally been answered in one of two ways: a “maximalist” response that identifies religion as a necessary foundation for human rights, and a “minimalist” response that rejects this turn to religion. A significant portion of the book is devoted to assessing representatives of these two approaches. Chapter 2 includes a discussion of maximalist thinkers Michael Perry, Max Stackhouse, Hans Küng, and Nicholas Wolterstorff. Chapters 3 through 5 consider different forms of minimalism, including that found in the work of John Rawls and Martha Nussbaum.Kao’s organization of the debate into maximalism and minimalism imposes a useful typology over a diverse range of thought while also establishing interesting points of contact and contestation among various thinkers. At the same time, because the analysis occurs at a rather high level of abstraction, it will be most useful to those already familiar with the texts and thinkers discussed. At its most basic, human rights, Kao argues, must be grounded in a nonreligious moral realism. This “straddling” of the “minimalist-maximalist divide” is, in certain respects, a creative and bold proposal for reshaping debate about religion and human rights. It defends the universality of human rights as being necessarily grounded in objective values but does not narrowly locate these values in religious sources. Yet, while offering some intriguing insights, the themes of this final chapter never quite come together to form a comprehensive theory. Kao’s proposal is more a selective appropriation of insights from others than a totalizing alternative.Because Kao does not fully develop her model, it is difficult to assess the particular rights claims that follow from its premises. This is evident, for instance, in Kao’s discussion of the so-called marginal cases, where it remains unclear what specific principles and methods have been employed to develop normative positions (160–61). Kao and Ilsup Ahn suggest two ways of conceptualizing Asian American Christian ethics. They describe the first as "agency- (...) or advocacy-centered" and the second as "bringing Western and Asian philosophical, theological, and cultural traditions together in critical dialogue and for selective retrieval for Asian American Christian ethics" (11). While the contributors to this book rightfully develop agency and advocacy-centered approaches within complex histories of colonialism and oppression, they also emulate Michael Walzer's "connected critic" who is not naïvely or uncritically "neutral" or dispassionate. The contributors appropriately use co-critical approaches that make possible "new and creative 'traditioning'" that does not uncritically reinscribe some "purer" Asian past or "undefiled by Western contact" (15).Nearly every chapter unpacks the deeply problematic term "Asian American" that was originally employed by activists who sought a new identity as "self-determining subjects rather than as 'oriental objects' in the United States" (4). But the term obfuscates multiple diversities within richly divergent national, geographical, colonial, and cultural histories and traditions.Hoon Choi explores the complexity of gender and sexual identities through a richly textured intersectional approach, examines how these identities become intertwined in double and triple binds, and reinterprets Christ as the fullness of humanity against Western hegemony and Eastern sexism. Choi's vibrant reinterpretation of Jesus Christ is complemented by a wise and compassionate pastoral approach.Sharon M. Se intentará explorar, en un primer apartado, la acusación löwithiana de “ocasionalismo ateológico”, formulada, aunque bajo pseudónimo, en un texto crítico de 1935 cuyo título original fue luego reemplazado por aquel con el que se lo conoce actualmente: Der okkasionelle Dezisionismus von Carl Schmitt [El (...) decisionismo ocasional de Carl Schmitt]. It has been divided into two parts. The first was published on May 15, 1930. The second was June 3, (...) 1930. The subject of reflection is the problem of “partisanism,” which is considered from two perspectives — metaphysical and social. The first one makes “partisanism” a manifestation of compensation, falsification of one’s being and lack of acceptance for one’s own vocation. The second one indicates that “partisanism” is a historical phenomenon, the beginning of which is the nineteenth century. Then, for the first time, society is understood as a permanent and eternal struggle. This requires as a consequence the constitution of fighting groups, called parties. Ortega, on the other hand, wants to overcome both versions of “partisanism.” Therefore, it is on the side of the authenticity of our individual life and independent of the party, ideas, feelings and values. _Purpose_ of the article is to find out the main content and ways of embodying freedom as a value of the volunteer movement in the context of analyzing the social motivation of human behavior in general. _Theoretical basis._ The theoretical basis of the research is the philosophical and anthropological understanding of freedom as a person’s creative overcoming of obstacles to establish his or her eccentric essence. Such a vision is embedded, in particular, in Karl Jaspers’ philosophy of existence, Helmuth (...) Plessner’s philosophy of positioning in the world, and Paul Ricœur’s philosophy of rational choice of life path. _Originality__._ The importance of freedom as a value, as well as other social values, is revealed and specified through the analysis of the values of the volunteer movement. In the desire of people engaged in volunteer work to achieve freedom through other values, the content of freedom as a basis for self-reproduction of the individual, community and society is revealed. _Conclusions._ Representatives of various humanities and social sciences have distinct research interests in analyzing the values inherent in volunteers. As members of a certain society and certain communities in this society, volunteers do not act outside the economy, politics and other spheres of public life, but reveal their freedom through creative and non-standard solutions to economic, political, and other problems. At the same time, research psychologists focus attention on the personal self-realization of a person, theorists and practitioners of social work study volunteers’ desire to gain recognition from peers and other small social groups, and representatives of sociology, political science and other social sciences focus their attention on such socially significant values of volunteering as patriotism, solidarity, etc. The task of social philosophy is to justify the desire to contribute to the public good, which is common to all volunteers. Representatives of philosophical anthropology look for the best social intentions inherent in a person as a member of society in volunteering. Analysis of the values of volunteering as a motivator of human behavior provides knowledge of socially significant values inherent in every member of society to a greater or lesser extent. (shrink)

Finality, the characteristic sign of vital processes, implies no opposition to causality; on the contrary the causal method of thinking must be applied to living nature. We must, however, distinguish between a final causality, one directed towards reaching a specific goal, and a causality which works mechanically without reference to a goal.A final or teleological treatment is applicable to inanimate nature as well, and is by many philosophers and physicists so applied. This teleology is however merely the inverse of causality. (...) According as we look forwards or backwards along the course of an event we can think of it in terms of means and end or of cause and effect . This method of interpretation can in the inorganic realm be applied to any stage of a process. In contradistinction therefrom the stages of the processes which occur in living nature are in no way equivalent, inasmuch as only one quite definite state can be regarded as the real and specific goal of the particular process. In his paper "Finitism", W.W. Tait maintains that the chief difficulty for everyone who wishes to understand Hilbert's conception of finitist mathematics is this: to specify the sense of the provability of general statements about the natural numbers without presupposing infinite totalities. Tait further argues that all finitist reasoning is essentially primitive recursive. In this paper, we attempt to show that his thesis "The finitist functions are precisely the primitive recursive functions" is disputable and that another, likewise defended by him, (...) is untenable. The second thesis is that the finitist theorems are precisely the universal closures of the equations that can be proved in PRA. /// En su articulo "Finitism", W.W. En este artículo, el autor desarrolla el problema de la tolerancia en una sociedad multicultural según el planteamiento de Karl-Otto Apel y el punto de vista de la ética del discurso. En este sentido, parte explicando que el problema actual de la tolerancia consiste en el desafío de abrir un espacio a las diferentes formas de vida socio cultural. Así, expone las contradicciones de la versión de tolerancia negativa en el liberalismo y las insuficiencias de la crítica comunitarista. Luego, (...) se presenta la propuesta de fundamentación ético-discursiva de lo que el filósofo alemán llama como ‘tolerancia afirmativa'. Se concluye con algunas consideraciones valorativas: primero, para cuestionar la necesidad de la tolerancia afirmativa en un régimen constitucional, y segundo, para postular que la fundamentación ético-discursiva de la tolerancia encuentra su derivación más coherente en la categoría del respeto. In this article the author develops the problem of tolerance in a multicultural society according to Karl-Otto Apel's position and the point of view of the ethics of discourse. The author explains that the challenge of opening a space to different forms of socio-cultural life is the current problem of tolerance. This way, he exposes the contradictions of the negative tolerance in liberalism and the communitarian critical insufficiencies. Therefore, he presents the proposal of ethical-discursive basis about what the German philosopher has called ‘affirmative tolerance'. This study concludes with some value considerations which are meant to question the necessity of affirmative tolerance in a constitutional regime, in first place, and to postulate, in second place, that the ethical-discursive basis of tolerance finds a more coherent derivation in the category of respect. Bilime ve bilimsel bilgiye yönelik yaygın görüş, bilimin objektif bir faaliyet olduğudur. Bu görüş bilimsel bilginin elde edilmesinde, bilim insanlarının nesnel bir tavır sergilediğini ve onların sosyal faktörlerden etkilenmediğini varsaymaktadır. Yirminci yüzyılın ikinci çeyreğinde, Viyana Çevresi ve Karl Popper’ın düşünceleri ile bilimde sosyolojik ve psikolojik unsurların keşif bağlamı içerisinde görülebileceği, bilimsel kuramların ve araştırmaların gerekçelendirilmesine yönelik girişimlerin ise yalnızca nesnel, epistemik çalışmalardan oluştuğu ileri sürülmektedir. El objetivo de este artículo es defender que la pragmática transcendental ofrece la fundamentación normativa de la teoría crítica como teoría de la acción comunicativa. Para ello se expondrá en primer lugar el problema de la normatividad en la Teoría Crítica de la sociedad. Tras describir la forma que adquiere esta teoría tras el giro lingüístico operado por Jürgen Habermas, se reconstruirán en tercer lugar los elementos fundamentales de la pragmática transcendental apeliana y habermasiana. En cuarto y último lugar se (...) mostrará que este modelo constituye la fundamentación normativa de la nueva teoría crítica. The aim of this paper is to argue that transcendental pragmatics constitutes the normative foundation of critical theory, understood as theory of communicative action. To that end, the issue of normativity within Critical Theory discussions is first exposed. After describing the form this theory takes from the linguistic turn carried out by Jürgen Habermas, key elements of Karl Otto Apel´s and Jürgen Habermas´ transcendental pragmatics are thirdly reconstructed. Fourth paragraph shows that this model operates as the normative foundation of the new critical theory. (shrink)

The author examines two open questions for religious ethicists: whether continuing to have children is a bad idea, given the challenges of antinatalism and climate change, and how we should evaluate the future of reproductive technology. Kao responds to these questions without resolving them by drawing upon human rights, the reproductive justice framework, and principles of social justice.

Cell biologists, including those seeking molecular mechanistic explanations of cellular phenomena, frequently rely on experimental strategies focused on identifying the cellular context relevant to their investigations. We suggest that such practices can be understood as a guided decomposition strategy, where molecular explanations of phenomena are defined in relation to natural contextual (cell) boundaries. This “top-down” strategy contrasts with “bottom-up” reductionist approaches where well-defined molecular structures and activities are orphaned by their displacement from actual biological functions. We focus on the central (...) role of microscopic imaging in cell biology to uncover possible constraints on the system. We show how identified constraints are used heuristically to limit possible mechanistic explanations to those that are biologically meaningful. Historical examples of this process described here include discovery of the mechanism of oxidative phosphorylation in mitochondria, molecular explanation of the first steps in protein secretion, and identification of molecular motors. We suggest that these instances are examples of a form of downward causation or, more specifically, constraining relations, where higher-level structures and variables delimit and enable lower-level system states. The guided decomposition strategy in our historical cases illustrates the irreducibility of experimentally identified constraints in explaining biological activities of cells. Rather than viewing decomposition and recomposition as separate epistemic activities, we contend that they need to be iteratively integrated to account for the ontological complexity of multi-level systems. In this paper we provide some keys for understanding the cryptic essay “Karl Kraus” by Walter Benjamin. For this purpose, we highlight the Kraus’s importance for the journalistic and political criticism that Benjamin was interested in, we introduce the reader to the three parts of the essay and we make a brief reflection on the construction of the concept of critique in Benjamin based on the work of Kraus.

Karl Popper held an opposition to determinism, based mainly in his political and ethical convictions. Nevertheless, most of his reflections upon it belong to epistemology. This paper studies Popper's refutation of determinism and his three main arguments of a priori nature against it. Some attention is paid also to the Popperian interpretation of quantic mechanical indeterminism.

Det er eit uttalt mål å gjøre grunnskulelærarutdanninga forskingsbasert. I det dominerande tankemønsteret i grunnskulelærarutdanninga er det konstruert ei motsetning mellom vitskapleg kunnskap og erfaringskunnskap. Vitskapleg kunnskap vert skildra som noko positivt, medan erfaringskunnskap får ei negativ omtale. Dette filosofiske essayet vil framskrive ei re-oppfatning av denne dikotomien. Målet med arbeidet er å redusere dikotomien mellom desse to kunnskapsformene og vise ei forståing som er meir jambyrdig, og som samlande kan bli kalla for lærarens levande kunnskap. Teorien om levande kunnskap (...) tar utgangpunkt i mennesket si heilskapande erkjenningsevne. Mennesket sin kognitive kapasitet inneheld både rasjonelle, etiske, emosjonelle og motoriske erkjenningar. Eit avgjørande aspekt med den levande kunnskapen er lærarens etiske- emosjonelle kunnskap og sensibilitet i tillegg til den logisk rasjonelle evna. (shrink)

In the 1950s and 1960s, the search for the mechanism of oxidative phosphorylation by biochemists paralleled the description of mitochondrial form by George Palade and Fritiof Sjöstrand using electron microscopy. This paper explores the extent to which biochemists studying oxidative phosphorylation took mitochondrial form into account in the formulation of hypotheses, design of experiments, and interpretation of results. By examining experimental approaches employed by the biochemists studying oxidative phosphorylation, and their interactions with Palade, I suggest that use of mitochondrial form (...) as a guide to experimentation and interpretation varied considerably among investigators. Most notably, Peter Mitchell, whose chemiosmotic hypothesis was ultimately the basis of the correct mechanism of oxidative phosphorylation, incorporated crucial aspects of mitochondrial form into his model that others failed to recognize. I discuss these historical observations in terms of the background and training of the biochemists, as well as a proposed heuristic of form, whose use may increase the possibility that biologically meaningful molecular mechanisms will be discovered. The purpose of this paper is to reflect on how the Corona pandemic might influence human understanding of our position of being in the world. In the first part of the paper, we present how a pandemic can be under- stood in relation to our society and our educational system. Then, we will present problems and questions highlighted by the pandemic and the kind of transformations needed to address these problems. The core ele- ments that require transformation are the understanding (...) of the essence of man or the human condition, the understanding of what caring for nature and even a pandemic means, and how to measure human action and values. Karl Pflock has done a thorough job of deflating the widely held myth that an alien spacecraft , with aliens aboard, crashed in New Mexico in early July 1947. To bolster his case he spent a great deal of time and effort in tracking down “eyewitnesses,” unearthing obscure documents, and untangling the tangled story from its beginning up to the present. Primary sources are used wherever possible, and the relevant affidavits, formerly classified reports, and so forth are not only (...) cited fully but in many cases reproduced in the text or in one of the appendixes.Pflock often goes into very fine and intricate detail indeed, but as a result he makes a convincing case. For example, it is fascinating to “follow the trail back” and watch the purported hundreds of eyewitnesses dwindle to a handful, none of whom produced any hard evidence of extraterrestrials. Equally engrossing are matters such as how the myth spread and grew ever more complex, the role of the media in the whole affair, and the enshrinement of “Roswell” as an accepted fact by many.The Roswell incident took place just a couple of weeks after the famous first sighting of UFOs by Kenneth Arnold near Mount Rainier on 24 June 1947. The media played the latter story for all it was worth, and for months afterward newspapers large and small ran prominent stories about the literally hundreds, if not thousands, of flying saucer reports that suddenly poured in from “reliable witnesses” . Roswell got on this bandwagon early, so it is not surprising that it achieved widespread fame. Moreover, that prominence has lasted, as one can confirm by visiting many a bookstore or public library.Of course there was something found in New Mexico in July 1947, and there were indeed secret projects going on at that time and place, although aliens and their spaceships played no part in matters. Instead, as Pflock demonstrates pretty clearly, the explanation is much more mundane .While this book is a thorough refutation of the Roswell affair, one may ask why we should read it, let alone buy it. After all, isn't this just another case of mass delusion, of interest to psychiatrists, sociologists, and the like, but not to many more?One answer is that the Roswell myth is recent, and indeed still forming, so that we can examine the process in almost as much detail as we like and from almost any aspect we choose. And while this immediacy may deny us historical perspective, it does provide us with a point of view that no future generation can have.Another answer is that no reader of Isis is immune from the possibility of being asked sometime, somewhere, by someone, “Do you believe in flying saucers?” “Are aliens visiting Earth?” or, more to the point, “What about Roswell?” As the last is the most famous and widely believed‐in topic in all of ufology, it might be useful to keep Pflock's book handy. There should be little fear of the subject going out of date, as half a century later the television series Roswell is now in its third successful year, public interest is renewed after every TV “documentary” on the topic, and the International UFO Museum and Research Center is still the main attraction in the city of Roswell.As Pflock points out, the Roswell affair is yet another example of how myth can take precedence over reality and how the will to believe can be strengthened by evidence to the contrary. In this respect we might all glance in a mirror, for similar delusions can be held not only by the uninformed but also by scholars; no doubt many readers can recall, with wry chuckles, examples in their own fields.Perhaps this New Mexican fable will never die. However, at least we can do our best to speed it on its way, and this book can be a big help in such an effort. In short, buy this book, read it, keep it available, and above all donate a second copy to your local public library. (shrink)

I identify three functions of language: the communicative, the objectifying, and the objective. I claim that of these three functions, the objective function is the most essential, in the sense specified in the paper, and the communicative the least. I further indicate that language use without the communicative function is more prevalent than might commonly be believed.

Affirmer que Popper a été profondément influencé, non seulement par la théorie du langage de Bühler, mais aussi par sa psychologie, ne correspond pas à l’opinion courante. Le deuxième chapitre de Die beiden Grundprobleme der Erkenntis montre clairement que Karl Bühler a représenté l’un des points de départ les plus importants de la théorie de l’esprit de Popper. Selon Popper, dans l’épistémologie de Carnap, il y a un (...) « préjudice inductif » : afin de rétablir une opinion neutre et adopter une épistémologie qui soit indépendante de la psychologie, il est nécessaire de démontrer que, dans la psychologie aussi, le déductivisme est possible et concevable. Popper donne des exemples très clairs de psychologie déductive et cite la théorie de Kant, Johannes Mueller, l’École Wuerzburg et Ernst Mach. Le choix de tels exemples est significatif afin de comprendre la nature de la formation de Popper. En particulier, il est important de souligner l’absence de la « psychologie de la Gestalt » ou de ses penseurs, tels que Wertheimer, Koehler, Koffka, etc. En effet, Bühler s’opposait fortement à la psychologie de la Gestalt de l’École Wertheimer et, entre l’Institut Bühler de Vienne et les psychologues de la Gestalt à Berlin, il y avait une véritable rivalité. According to Popper, an “inductive prejudice” is contained in Carnap's epistemology : to restore a neutral point of view and to adopt an epistemology independent of psychology, it is necessary to show that, within the psychology, the deductivism is also possible, or thinkable. Popper provides some clear examples of deductive psychology and cites Kant's outlook, Johannes Mueller, the Wuerzburg's school and Ernst Mach. The choice of such examples is very important for the understanding of the nature of Popper's training. It is significant, in particular, the absence of the Gestaltpsychology or of its exponents, such as Wertheimer, Koehler, Koffka etc. In fact, Bühler was in sharp contrast with the Gestaltpsychology of Wertheimer's school and between the Bühler's Vienna Institute and the Berlin Gestalt -psychologists there was a real rivalry. Popper — who by the standard view is simplistically considered “a gestaltist psychologist” — adopted completely the Bühler's point of view. (shrink)
